By downloading, accessing, or using the Nailify mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Nailify ("we," "us," or "our") regarding your use of the Nailify mobile application (the "App"). By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Nailify is a mobile application that provides the following services:

The AI-generated assessments and recommendations are based on visual analysis only and may not be accurate or complete. Always consult with a dermatologist, doctor, or qualified healthcare provider for any concerns about your nail health.
We are not responsible for any health issues, injuries, or damages resulting from your use of or reliance on the information provided by Nailify.
Nailify and all its content, features, and functionality (including but not limited to software, text, designs, graphics, logos, and AI models) are owned by us or our licensors and are protected by international copyright, trademark, patent, and other intellectual property laws.
You retain ownership of all photos you upload to Nailify. By uploading photos, you grant us a limited, non-exclusive, worldwide license to:
This license terminates when you delete your photos or account. We do not use your photos for any other purposes, such as marketing or training AI models, without your explicit consent.
AI-generated nail designs and analysis results are created specifically for you. You may use these results for personal purposes, but you acknowledge that:
Nailify offers both free features and premium features available through in-app purchases or subscriptions managed by Superwall and Apple's In-App Purchase system.
Refund policies are governed by Apple's App Store terms. We do not have direct control over refunds. To request a refund, contact Apple Support or submit a refund request through your Apple account.

We use Firebase for authentication, data storage, analytics, crash reporting, and notifications. Your use of Firebase services is subject to Google's Terms of Service and Privacy Policy.
We use OpenRouter and fal.ai for AI processing. Your photos are sent to these services for analysis and generation. These services have their own terms and privacy policies.
We use Superwall for subscription management. Superwall's terms and privacy policy apply to subscription data.
We are not responsible for any issues, downtime, or changes to these third-party services that may affect your use of Nailify. We do not control these services and cannot guarantee their availability, security, or accuracy.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using Nailify, you also agree to the terms of our Privacy Policy.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
You agree to indemnify, defend, and hold harmless Nailify, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice to you.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, pandemic, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
